Ningxia Hui Autonomous Region Live Pig Slaughter Management Measures

The Ningxia Hui Autonomous Region People's Government Decree No. 44 “Nongxia Hui Autonomous Region Live Pig Slaughter Management Measures” was discussed and adopted at the 108th executive meeting of the People’s Government of the Autonomous Region on December 26, 2011 and is hereby promulgated, and will come into effect on March 1, 2012.

Wang Zhengwei, Chairman of the Autonomous Region, December 26, 2001 Article 1 In order to strengthen pig slaughtering management, ensure the quality of live pig products, and protect the health of the people, the Regulations of the State Council on "Live Pig Slaughter Management" and related laws and regulations In light of the actual conditions of the autonomous region, these Measures are formulated.

Article 2 All units and individuals engaged in the slaughter of live pigs or sales and processing of live pig products in the administrative regions of this autonomous region shall abide by these Measures.

Article 3 The hog products referred to in these Measures refer to carcasses, meats, fats, organs, bones, blood, heads, hoofs, and skins that have not been processed after slaughter of live pigs.

Article 4 The autonomous region shall adopt a system of designated slaughter and centralized quarantine of live pigs.

Article 5 The competent commerce department of the people's government at or above the county level shall be responsible for the supervision and management of live pig slaughter activities within its administrative area.

The departments of agriculture, animal husbandry, industry and commerce, health, taxation, price, housing, urban and rural construction, and environmental protection are responsible for the relevant management of live pig slaughter activities within the scope of their respective duties in accordance with relevant laws and regulations.

The township (town) people's government assists the commerce authorities of the people's government at or above the county level in supervising and managing live pig slaughter activities, and cooperates with the animal health supervision agencies in the quarantine work of live pigs.

Article 6 The planning of the designated slaughterhouses (fields) shall be planned by the competent department of commerce of the People's Government of the autonomous region in conjunction with relevant departments such as farming, animal husbandry, environmental protection, and housing and urban-rural development, in accordance with unified planning, rational distribution, proper concentration, favorable circulation, and convenience for the people. The principle is drawn up and reported to the People's Government of the Autonomous Region for approval before implementation.

Article 7 The designated slaughter plant (field) shall meet the following conditions:

(1) Water source conditions that are commensurate with the scale of slaughter and the water quality conforms to the national standards;

(2) There are slaughterhouses, slaughterhouses, emergency slaughterhouses and live pig slaughtering equipment and delivery vehicles that meet the requirements of the state regulations;

(3) Slaughter technicians who have obtained health certificates according to law;

(4) Having qualified meat quality inspectors;

(5) There are inspection equipments, disinfection facilities and pollution prevention facilities that meet the requirements of the national regulations;

(6) facilities for the harmless treatment of live pigs and pig products;

(7) Acquire the qualification certificate for animal epidemic prevention according to law.

Article 8 Live pig designated slaughter plants (fields) shall be organized by the city-level people's government of the district to organize the departments of commerce, agriculture and animal husbandry, environmental protection, land and resources, and housing urban and rural construction. According to the planning set by the autonomous region's people's government, designated pig slaughterhouses (fields). And in accordance with the conditions stipulated in Article 7 of these Measures. After having solicited the opinions of the competent commercial authorities of the autonomous region in writing, they either agreed or disagreed with the written decision to establish a pig slaughterhouse (site).

The applicant can only start construction of the slaughterhouse (field) after obtaining the written decision of consent of the municipal people's government in the district.

After the completion of the slaughter plant (field), the municipal people's government in the district shall organize the departments of commerce, agriculture, animal husbandry, environmental protection, land and resources, and housing urban and rural construction to carry out inspection and acceptance. Article 9 Live pigs slaughtered at designated slaughter plants (sites) shall have quarantine certificates and livestock and poultry identifications issued by animal health supervision agencies of origins, animal health supervision agencies shall conduct quarantine inspections at the slaughtering sites according to law, and shall affix animal health supervision agencies to live pig products. Article 10 The designated slaughterhouses (farms) shall slaughter live pigs in accordance with the operational regulations and technical requirements stipulated by the State.

Article 11 The meat quality inspection at the designated slaughterhouses (fields) shall be conducted simultaneously with the live pig slaughtering. The live pig products that have passed the inspection of meat quality shall be stamped with the quality inspection certificate of the meat before they leave the factory (field); the live pig products that fail the quality inspection of meat products shall be under the supervision of the meat quality inspection personnel. Live pig products slaughtered at designated slaughter plants (farms) may not leave the factory (field) if they have not passed the inspection of meat quality or the quality inspection of meat products.

Article 12 The designated slaughter plant (farm) shall not inject water or inject other substances into live pigs and pig products.

Article 13 The designated slaughterhouse (site) may purchase live pigs on its own, and may also provide the service of the deceit and slaughtering services. The service fee for demolition and processing services shall be charged according to the standards approved by the competent pricing department.

Article 14 The designated slaughterhouses (farms) shall not delimit the scope of services. Customers may randomly select slaughterhouses (farms) to slaughter live pigs. No unit or individual may interfere.

Article 15 A designated slaughterhouse (site) shall take necessary measures such as freezing or cold storage for the live pig products that are not sold on time or delivered (field) in time.

Article 16 Units and individuals transporting live pig products shall use sealed and suspended vehicles or other measures to prevent pollution.

Article 17 Units and individuals selling pig products may not sell pig products slaughtered at slaughterhouses (fields) other than fixed-points.

The catering industry, collective food service units, and units and individuals engaged in the processing of live pig products shall not purchase or process pig products slaughtered at slaughter plants (sites) at non-fixed points.

Article 18 No unit or individual may transfer, alter or fake the quarantine certificates for live pigs, quarantine seals or seals for inspection of meat quality, or signs for slaughterhouses (fields).

Article 19 Livestock slaughter law enforcement officers shall present their certificates and perform sensory inspections, sampling tests, data access, inquiries, and verification of inspections, etc. The relevant units and individuals shall cooperate and shall not refuse or hinder.

Article 20 In case of violation of the provisions of the present Measures, the relevant laws, regulations and rules such as the "Live Pig Slaughter Regulations" stipulate the legal responsibility, and shall be implemented in accordance with the relevant laws, regulations and rules.

Article 21 If a party is not satisfied with the administrative punishment decision made by the administrative department, it may apply for administrative review or file a lawsuit according to law. If it does not apply for reconsideration nor file a lawsuit within the time limit, and it does not implement the punishment decision, the administrative organ that made the decision on punishment shall apply to the people's court for enforcement.

Article 22 If a staff member of the competent commerce department or other relevant department abuses his power, neglects his duty, or engages in malpractices for personal gains, he shall be given a punishment in accordance with the law; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 23 The present Measures shall come into force on March 1, 2012.
